Here are things that are important to bring to your first consultation appointment if you have them.  If you do not have these items, know that your attorney will be asking for them at some point.

  • Date/Time of incident
  • Location of incident
  • Name and contact information of the other involved party(s)
  • Any pictures of property damage or scene of incident (pictures or your vehicle and theirs if you have them)
  • Any pictures of physical injuries—the closer to the date of the incident the better.
  • Police report information. (If you have a copy of a police report or incident report please bring a copy with you)
  • Your automobile or home owner’s policy (If applicable)
  • The other party’s insurance information (home owners, car insurance or business insurance) If they are not willing to share their policy number with you at least see if they will pass along the name of the insurance and insurance contact information.
  • Names/Contact information of anyone else involved in the incident
  • Names/Contact information for any witnesses
  • Any correspondence you received pertaining to this incident
  • A copy of any traffic/law enforcement citations you may have been issued
  • All the names/locations of any places you received or are currently receiving medical care including but not limited to:
    • Ambulance Services
    • ER Visit
    • Hospital Stay (all bills involved)
    • Physical Therapy
    • Chiropractic Care
    • Follow UP Visits
    • Long Term Care Needs
    • Pharmacy receipts
    • Over the counter receipts for bandages, crutches, braces etc.
  • Copies of all receipts you have relating to the incident including but not limited to:
    • Any out of pocket expenses for deductibles
    • Any rental car receipts
    • Receipts for any repairs completed due to the incident
    • Any receipts you think impact your case
  • Any estimates on damage repair(s) related to the incident

Divorce from a Child’s Perspective

Divorce is a scary, confusing time in a child’s life—no matter what the age.  While it may not always come as a surprise, it can still alter a child’s world of what they believed to be true and good.  Imagine being a child and then believing the people you love most in the world now ‘hate’ each other.  Now add the feeling of having no control over what your own life and the uncertainty of what the future holds.

At Boehmer Law, we know what it can be like for children when their parents are going through a combative divorce.  It is key to remember that children examine what you say, and they can feel your struggles as well.  In the middle of having your family breaking up, it is easy to get caught up in your own life and not be aware of what is happening to your kids.   Some kids act out, some kids shut down.  Everyone reacts to the stress of this time differently.  Watch for dramatic behavior swings or mood changes—these are big clues on what is going on in your child’s mind.  Open the lines of communication in a ‘consequence free’ tone so your kids can talk to you about their hurt, anger, fears or whatever else is on their mind.

Remembering the impact of your emotions on your children may allow you to choose the time to break down, and to keep the adult issues between the adults.  Kids never need to be the go-between parents as this puts them in the awkward position of potential misdirected anger being pointed in their direction.

Mr. Jason Cordes is a recent addition to the Boehmer Law Firm. Mr. Cordes has been practicing criminal, family and civil law areas for over 13 years. Prior to joining Boehmer Law, he worked hard defending clients charged with Missouri DWI/DUI, drug possession, and other criminal matters. Mr. Cordes also worked in a general practice firm working on civil matters, wills and estate planning, and family law. During that time, Mr. Cordes had a diverse practice that included arguing appeals and working as a municipal prosecutor.

Mr. Cordes obtained his law degree from the University of Missouri-Columbia, and holds an undergraduate degree from the University of Central Missouri.

Mr. Cordes enjoys spending much of his spare time with his fiancée Rose. He attends the Gateway Christian Church and is also an avid marksman and reader.

Honesty Is The Best Policy During Custody Proceedings

Throughout custody hearings, (especially highly contested hearings) it is imperative for you to keep in mind that your actions or in-actions are being noticed by the courts and all those involved in the custody hearing. Never assume that something you may have done in your past, (even if you think no one knows about) will not come out in court.  Most likely, during litigation, someone will find out about what you have concerns about and want to keep hidden.  However,the worst thing you can do is hide something like a previous domestic assault or child endangerment charge from your lawyer. No one likes to be surprised by things they did not know or have not prepared for in court, especially your attorney who is there to fight for you.

Parents involved in a heated custody battle want to look as good as possible to gain an advantage with the courts and no one wants to have to admit previous mistakes. However, the importance of being honest with the person who is working for you during litigation can be a major deciding factor in how your case is handled in court and may affect the outcome of your case.

We are all human and have made mistakes or poor choices from time to time, and most lawyers have seen and heard a lot; so do not be afraid or embarrassed to discuss any topics or concerns with your attorney. Julia O’Connor Joins the Boehmer Law Family Law and Divorce Legal Team

Boehmer Law is pleased to announce the addition of Julia O’Connor to our Family and Divorce Law Legal Team.

A native of St. Charles, MO, Julia O’Connor graduated from St. Dominic High School. Julia then attended Truman State University, where she earned her BS degree in Justice Systems, with minors in Political Science and Psychology. While attending Truman, Julia was a member of a national Criminal Justice social fraternity. Julia earned her Juris Doctorate at Arizona Summit Law School in Phoenix, Arizona.

While in law school, she was one of the charter members of Delta Theta Phi – Mary Ann Richey Chapter. She was also a member of the Student Bar Association throughout her time in law school and headed up a number of various committees for the organization. Julia also earned a CALI award for excellence during law school.

Coming from a family with a heavy law enforcement background, Julia has always been a strong supporter for Backstoppers – an organization focused on assisting the families of first responders killed in the line of duty. She also volunteers for Youth in Need – Head Start. In May of this year, she was appointed as a member of the Board of Directors for Beautyful Waves – a non-profit organization which aims to partner with the community to assist young girls aging out of the foster care system and/or girls who do not have a consistent support system in their lives; and she will be heading up its forthcoming mentorship program.

Julia now resides in St. Charles, Missouri and is a member of the Missouri Bar, the Arizona Bar, and is a licensed Guardian Ad Litem.

Questions To Ask Before Hiring An Attorney

Choosing the right attorney to handle your legal matters is a very important choice.  You will want to speak with an attorney to decide if they have the knowledge and experience to handle your particular legal matter.  Here are some questions you may want to ask before deciding on which attorney you want to hire.

Find out if he/she has experience in the type of law you need to handle your case. You want to have the peace of mind that the person handling your case has the knowledge and experience to get the job done.

Have you handled many of this type of case?

Find out if your type of case is more difficult than what they are used to handling, especially with felonies. You want to know that they understand the system and the laws that apply to your type of case. Ask them if they have ever handled a case like yours and what approach did they use on those cases.

How much trial experience do you have?

Find out if he/she is willing to try your case. Do they have a reputation for trying cases? Have they ever tried a case before? You want someone who has confidence and experience inside a court room. Ask how much experience they have with jury selection and direct cross examination.   Be sure to specify between a judge and a jury trial. Not every lawyer tries cases, and even fewer try cases by jury.

What is your trial success rate?

It is rare to find a successful jury trial lawyer, especially with multiple victories in an actual courtroom. If someone is advertising they have many ‘victories’ probe deeper and find out what they define as winning a court case, especially as it applies to doing actual trials in a court room.

How much will my case cost and do you accept payment plans?

You want to make sure you understand all the fees and costs upfront to your case. Here are some tips that may help you in these situations.

  • Get and keep receipts of every transaction, especially if you pay with cash.
    • If you pay your child support in cash, have the other party sign a receipt saying the date and amount of cash they received.
    • If you pay bills for agreed upon items such as child care, tuition or extra-curricular activities, ask for receipts that include the dates and amounts from the facility.
    • Keep note of any bills that you had to pay because the other party did not live up to their end of an agreement with notations on why they were supposed to pay according to your agreement and any documentation of reminders or requests for payment.
  • Keep a calendar of events
    • Note any of the visitations that you made including times, locations and any other important information that may be a part of your agreement.
    • Note visitations that someone missed and the reasons why

Remembering Our Heros

Memorial Day, the last Monday in May, in the United States is a day for remembering the men and women who gave the ultimate sacrafice of their lives while serving in our country’s armed forces. During this day many people visit cemeteries and memorials, attend remembrance services or celebrate with parades to honor those who have died in military service. Many volunteers place an American flag on each grave in America’s national cemeteries.

Memorial Day is not to be confused with Veteran’s Day.   Memorial Day is a day of remembering the men and women who perished while serving America, while Veterans Day celebrates the service of all U.S. military veterans.

We offer our greatest gratitude to those individuals who gave their lives for our freedoms and have protected our country. We extend our deepest sympathies to the families who have endured the death of their loved ones.
